1. Acceptance of Terms

By accessing or using the Vibexel platform (“Service”) at vibexel.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Access to the Service requires an invitation.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. Access is granted on an invite-only basis at our sole discretion.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You must not share your account or invite codes with unauthorized parties.
• You must promptly notify us of any unauthorized access to your account.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Interfere with or disrupt the Service, servers, or networks.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to generate, store, or distribute malware or malicious content.
• Abuse AI features by submitting harmful, illegal, or exploitative prompts.
• Circumvent rate limits, quotas, or other usage restrictions.
• Scrape, crawl, or otherwise extract data from the Service in bulk.

5. Intellectual Property

You retain ownership of all content and projects you create using the Service. We do not claim ownership of your code, files, or project data. The Vibexel platform, its design, branding, and underlying technology are our intellectual property and are protected by applicable laws.

6. AI-Generated Content

AI features within the Service generate responses using third-party models (Anthropic Claude). AI-generated content is provided “as is” without warranty of accuracy, completeness, or fitness for a particular purpose. You are responsible for reviewing and validating AI-generated content before use in production.

7. Credits & Billing

Certain features consume credits. Credits are non-refundable and non-transferable unless otherwise stated. We reserve the right to modify credit pricing and consumption rates with reasonable notice. Promotional credits may have expiration dates and usage restrictions.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss resulting from service downtime.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

10. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any reason at our sole discretion. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 11, and 12 survive termination.

11. Limitation of Liability

To the maximum extent permitted by law, Vibexel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
